US Judge Mandates Freedom of Abrego Garcia from Immigration Detention
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without legal authority.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.
The case originates in a erroneous deportation to El Salvador in March, which US authorities later admitted was an error. After his repatriation to the United States to face alien smuggling allegations, he was detained in immigration detention.
In her decision, the court pointed out that the authorities does not have a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
Background of the Case
The legal proceedings involve disputed claims. While the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.
He has also pleaded not guilty to the smuggling charges, which are part of a separate trial in the state of Tennessee.
